In most cases the “apostille” is understood as a simplified legalization of documents for their further use in other countries-members of the Convention.

 

The procedure of an apostille affixing (sometimes the procedure is called apostillation) is applied in cases when a country where a document is mean to be directed (the country of destination) is a member of the Hague Convention dated 5 October 1961 abolishing the requirement of consular legalization and introducing the procedure of simplified legalization – apostillation. If a country for which you prepare a document is a not a member of the Convention you'll need the consular legalization.

 

The apostille can be put on:

 

  • notarized documents (notarized copy, proxy of attorney, consent, order, etc.);
  • documents of legal entities (notarized copy of a charter, certificate of registration, certificate confirming registration, etc.);
  • original documents on education (diploma, school certificate, reference, etc.);
  • original documents issued by the Civil Registry Office (birth certificate, marriage certificate, etc.).

 

The apostille is affixed at the request of any presenter of a document directly on a free-from-text place of a document or its reverse side or a separate sheet of paper. In this case sheets of the document and the sheet of paper with the apostille are tied up together by their sowing with a thread of any color (or a special thin cord, a tape) and are numbered. The last sheet of the documents at the place of fastening is glued up by a thick paper "star" on which a stamp is affixed. The stamp must be placed evenly on the "star" and on the sheet. The number of sheets tied up together is certified by the signature of the person affixing the apostille. The sheet with the apostille must be tied up to the document by the above indicated method and in case if the document has a hard cover (for example, certificate issued by the Civil Registry Office).

 

The document bearing the apostille stamp can be used in any of the countries-members of the Hague Convention.

 

The service of apostilization costs 10,000 tenge per 1 document.

 

To apostillize a document you'll need the following:

 

  • translation of a document;
  • notarization;
  • a copy of ID card.

 

The services of documents translation and notarization are provided in addition according to operating tariffs.

 

Consular legalization rules

 

The consular legalization (further – legalization) consists in checking the compliance of documents to the current legislation of the state of residence and represents establishment and certification of authenticity of an official's signature and a stamp on such documents for the purpose of their using in another state. This procedure is regulated by the Consular legalization rules approved by the Order of the Minister of Foreign Affairs of the Republic of Kazakhstan No. 264 dated 21 November 2000.

 

In foreign countries the function of legalization is performed by foreign establishments of the Republic of Kazakhstan.
